These General Terms and Conditions (GTC) apply to all orders placed by consumers (within the meaning of Section 13 BGB) through the online shop www.christosminos.com with

Deviating terms and conditions of the customers are not recognized unless the Seller expressly agrees to their validity in writing.

OFFER AND CONTRACT CONCLUSION
(1) The presentation of products in the online shop does not constitute a legally binding offer but an invitation to submit an order.
(2) By clicking the “buy” button, the customer submits a binding offer to purchase the items contained in the shopping cart.
(3) The contract is concluded once the Seller confirms the order by email or dispatches the goods.
PRICES AND SHIPPING COSTS
(1) All prices indicated are final prices.
• If VAT is applicable, it is included in the price.
(2) In addition to the stated prices, shipping costs may apply. These are displayed separately during the order process.
DELIVERY AND SHIPPING
(1) Delivery is made within Germany and the entire EU by a commissioned delivery service [e.g. DHL / Hermes / UPS] to the address provided by the customer.
(2) Unless otherwise stated, shipping takes place within 7-14 working days after receipt of payment. As the goods are “custom-made artworks”, no liability is assumed for delays.
(3) The Seller assumes no liability for delays caused by commissioned delivery companies.
(4) Shipping is insured where possible. The Seller bears the risk of loss or damage until delivery to the customer.
RETURNS
(1) The customer bears the direct costs of returning the goods unless the Seller has expressly agreed otherwise or if the return is due to an error or defect caused by the Seller.
(2) The customer is obligated to insure the goods for return according to the Seller’s instructions.
(3) After receipt and inspection of the returned goods, a refund of the purchase price (minus any depreciation) will be made within 14 days via the same payment method used for the original order.

RETENTION OF TITLE
The artwork remains the property of the Seller until full payment has been received.
RIGHT OF WITHDRAWAL
Customers have the right to withdraw from the contract within 14 days without giving reasons. Detailed information is provided in the withdrawal policy.
COPYRIGHT AND USAGE RIGHTS
(1) When purchasing an artwork, the customer acquires the physical original, but no usage or exploitation rights under copyright law.
(2) Reproduction, publication, or commercial use of the artwork (e.g. as a print, poster, or digital file) is strictly prohibited.
WARRANTY
Statutory defect liability law applies. Since the artworks are handmade unique items, minor deviations in color, shape, and texture may occur and do not constitute defects.
LIABILITY
The Seller is liable only for damages caused by intentional or grossly negligent behavior. For simple negligence, the Seller is only liable for breaches of essential contractual obligations (cardinal duties).
DISPUTE RESOLUTION
The EU Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr
The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
The place of jurisdiction for all disputes arising from or in connection with this contract is Mönchengladbach. German law applies.
AMENDMENTS TO THE TERMS
These terms may be amended from time to time. If changes occur, they will be published on this page. Continued use of the website constitutes acceptance of the updated terms.
PERSONAL USE OF WEBSITES
This website is intended for personal and noncommercial use only. Any unauthorized use entitles the Seller to seek injunctive relief and all other legal remedies. Any other use of the content without prior written permission from the Seller is strictly prohibited.
